Terms of Service

By creating an account, checking the “I agree” box at sign-in, or otherwise using the 28 Day Action Plan™ service (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

The Service is operated by Elliott AI Foundry LLC (“Company,” “we,” “us,” or “our”).

28 Day Action Plan™ is an AI-powered goal-planning and accountability tool. It generates personalized 28-day action plans and provides daily coaching through Clarity, our AI companion. The Service is designed for individuals who want structured support in achieving their personal and professional goals.

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you represent that you have your parent or guardian’s permission to use the Service and that they have reviewed and agreed to these Terms on your behalf. By creating an account, you represent and warrant that you meet these requirements. The Service is intended for personal, non-commercial use.

You agree to provide accurate, complete, and current information when creating your account. You are responsible for maintaining the security of your account and for all activity that occurs under your account. Notify us immediately at operations@elliottaifoundry.com if you suspect unauthorized access.

You may use the Service for your own personal productivity, goal planning, and accountability purposes. You may copy or export your own plan and report content for personal use.

You may not use the Service to:

• Gather competitive intelligence. You may not analyze, benchmark, reverse-engineer, or collect information about the Service’s features, methodology, prompts, outputs, or interface design for the purpose of developing, improving, or marketing a competing product or service.
• Share your account or the Service’s outputs with third parties for competitive research, benchmarking, or product development purposes.
• Systematically scrape, copy, reproduce, or extract content, methodology, or data from the Service beyond your own personal plan and report content.
• Attempt to decompile, disassemble, or reverse-engineer any part of the Service, including its AI models, prompts, or workflows.
• Use the Service on behalf of a company or organization that is building, operating, or planning to build or operate a competing AI coaching or goal-planning product.
• Access or harvest other members’ data. You may not join the Service or use your account to view, copy, collect, export, or remove the personal information, plans, reports, or any other content belonging to other participants in the 28 Day Action Plan™ Skool community. That community is private, and its members’ content is shared in confidence among members only.
• Violate any applicable law or regulation, or infringe the rights of any third party.
• Attempt to gain unauthorized access to the Service, its servers, databases, or any related systems.

Violations of this section, particularly competitive intelligence gathering, may result in immediate account termination without notice and may subject you to legal liability.

All content, features, and functionality of the Service — including but not limited to the plan generation methodology, Clarity AI companion persona and interaction design, quiz design, interface design, brand identity, and all underlying software — are owned by Elliott AI Foundry LLC and protected by United States and international intellectual property laws.

Your personal plan content (the text of your generated plan and your daily reports) belongs to you. We do not claim ownership over the personal goals and plans you create through the Service.

The Service uses artificial intelligence to generate personalized plans and coaching responses. AI outputs are for informational and motivational purposes only. They do not constitute professional business, financial, medical, psychological, or legal advice. You are solely responsible for how you use the content the Service generates for you.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), and 12 (Governing Law).

The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will achieve any particular results. Your use of the Service is at your own risk.

To the maximum extent permitted by applicable law, Elliott AI Foundry LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

We may update these Terms from time to time. When we do, we will update the Effective Date above and increment the Version number. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you at the email address associated with your account.

These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising from or relating to these Terms or the Service shall be resolved in a court of competent jurisdiction in the United States.
